2. Hosting

External Hosting

This website is hosted externally. The personal data collected on this website is stored on the servers of the host(s). Insofar as consent has been requested, processing takes place solely on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG, provided that the consent includes the storage of cookies or access to information on the user's terminal device (e.g., device fingerprinting) within the meaning of the TTDSG. The consent can be revoked at any time.

Our host(s) will only process your data as far as it is necessary to fulfill their service obligations and will follow our instructions regarding this data.

Order Processing

We have entered into a data processing agreement (DPA) for the use of the aforementioned service. This is a legally required contract under data protection laws, ensuring that the service processes the personal data of our website visitors only according to our instructions and in compliance with the GDPR.

3. General Information and Mandatory Disclosures

Data Privacy

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations as well as this privacy policy.

When you use this website, various personal data will be collected. Personal data are data with which you can be personally identified. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this happens.

We would like to point out that data transmission over the Internet (e.g., communication via email) can have security vulnerabilities. Complete protection of data from access by third parties is not possible.

Notice Regarding the Responsible Entity

The responsible entity for data processing on this website is:

arcneo GmbH
Jens Bredler
Rudower Chaussee 29
12489 Berlin
Phone: +49 30 75438456
Email: contact@arcneo.de

The responsible entity is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g., names, email addresses, etc.).

Retention Period

Unless a more specific retention period has been mentioned within this privacy policy, your personal data will remain with us until the purpose for data processing no longer applies. If you assert a legitimate request for deletion or withdraw your consent to data processing, your data will be deleted, provided we do not have any other legally permissible grounds for retaining your personal data (e.g., tax or commercial law retention periods); in the latter case, deletion will occur after these reasons no longer apply.

General information on the legal basis of data processing on this website

If you have consented to data processing, we process your personal data based on Article 6(1)(a) GDPR or Article 9(2)(a) GDPR if special categories of data under Article 9(1) GDPR are processed. In the case of explicit consent to the transfer of personal data to third countries, data processing is also based on Article 49(1)(a) GDPR. If you have consented to the storage of cookies or access to information on your device (e.g., via device fingerprinting), data processing is also based on Section 25(1) TTDSG. Consent can be revoked at any time. If your data is required to fulfill a contract or pre-contractual measures, we process your data based on Article 6(1)(b) GDPR. Furthermore, we process your data if it is necessary to fulfill a legal obligation based on Article 6(1)(c) GDPR. Data processing can also occur based on our legitimate interest according to Article 6(1)(f) GDPR. The applicable legal bases in each specific case are outlined in the following sections of this privacy policy.

Notice on the transfer of data to third countries that do not provide adequate data protection and to US companies that are not DPF-certified

We use, among other things, tools from companies based in third countries that do not have secure data protection, as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). When these tools are active, your personal data can be transferred to these countries and processed there. We point out that in third countries that lack strong data protection, a level of data protection comparable to the EU cannot be guaranteed.

We point out that the USA, in principle, as a secure third country, has a level of data protection comparable to the EU. A data transfer to the USA is permissible if the recipient has certification under the "EU-US Data Privacy Framework" (DPF) or provides suitable additional guarantees. Information on transfers to third countries, including data recipients, can be found in this privacy policy.

Recipients of personal data

In the course of our business activities, we collaborate with various external entities. This sometimes necessitates the transfer of personal data to these external entities. We only share personal data with external entities when it is necessary for contract fulfillment, when we are legally obligated to do so (e.g., sharing data with tax authorities), when we have a legitimate interest according to Art. 6 para. 1 lit. f GDPR in passing on the data, or when another legal basis permits the data transfer. When utilizing data processors, we only share our customers' personal data based on a valid data processing agreement. In the case of joint processing, a joint processing agreement is concluded.

The company is certified under the "EU-US Data Privacy Framework" (DPF). The DPF is an agreement between the European Union and the United States designed to ensure compliance with European data protection standards during data processing in the U.S. Any company certified under the DPF is committed to adhering to these data protection standards. Revocation of Your Consent to Data Processing

Many data processing operations are only possible with your explicit consent. You may revoke a previously given consent at any time. The legality of data processing carried out prior to the revocation remains unaffected by the revocation.

Right to object to data collection in specific cases and to direct marketing (Art. 21 GDPR)

IF DATA PROCESSING IS BASED ON ARTICLE 6(1)(E) OR (F) OF THE GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE SPECIFIC LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS OR THE PROCESSING IS FOR THE ESTABLISHMENT, EXERCISE, OR DEFENSE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ARTICLE 21(1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR SUCH MARKETING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ARTICLE 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of GDPR violations, the affected individuals have the right to lodge a complaint with a supervisory authority, particularly in the member state of their usual residence, workplace, or the location of the alleged infringement. This right to lodge a complaint exists without prejudice to any other administrative or judicial remedies.

Right to Data Portability

You have the right to request the delivery of data that we process automatically on the basis of your consent or in fulfillment of a contract, either to yourself or to a third party, in a common, machine-readable format. If you request the direct transfer of data to another controller, this will only occur if it is technically feasible.

Information, Correction, and Deletion

Under the applicable legal provisions, you have the right to receive information about your stored personal data, their origin and recipients, and the purpose of data processing at any time and free of charge. You may also have the right to rectification or deletion of this data. For this and for any other questions regarding personal data, you can contact us at any time.

Right to Restriction of Processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restrict processing applies in the following cases:

  • If you dispute the accuracy of your personal data stored with us, we typically need time to verify this. During the verification period, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it to establish, exercise, or defend legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have filed an objection pursuant to Art. 21 para. 1 GDPR, a balance must be struck between your interests and ours. Until it is determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data – apart from being stored – may only be processed with your consent or for the establishment, exercise, or defense of legal claims or to protect the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.

SSL or TLS encryption

This page uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the website operator. You can recognize an encrypted connection by the fact that the browser's address bar changes from "http://" to "https://" and by the lock icon in your browser bar.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Objection to Promotional Emails

The use of contact details published as part of the legal notice requirement for the transmission of unsolicited advertising and informational materials is hereby opposed. The operators of the site expressly reserve the right to take legal action in the event of unsolicited sending of advertising information, such as spam emails.

4. Data Collection on This Website

Cookies

Our website uses so-called “cookies”. Cookies are small data packages that do no harm to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (persistent cookies). Session cookies are deleted automatically at the end of your visit. Persistent cookies remain on your device until you delete them yourself or your browser deletes them automatically.

Cookies may originate from us (first-party cookies) or from third parties (third-party cookies). Third-party cookies allow certain services of third-party companies to be integrated into websites.

Cookies that are required to carry out the electronic communication process or to provide functions you have explicitly requested (necessary cookies) are stored on the basis of Art. 6 para. 1 lit. f GDPR, unless another legal basis is stated. All other cookies and comparable recognition technologies are used exclusively on the basis of your consent (Art. 6 para. 1 lit. a GDPR and Sec. 25 para. 1 TTDSG).

Consent and withdrawal: When you first visit this website, we display a notice that lets you consent or decline. We store your decision in your browser's local storage under the key “arcneo-cookie-consent”; storing it is technically necessary so that we do not have to ask again on every page view. As long as you have not consented, we do not load any service that requires consent. You can change or withdraw your decision at any time via the “Cookie settings” link in the footer of every page; a withdrawal takes effect for the future.

You can also set your browser to inform you about the use of cookies, to allow cookies only in individual cases, to exclude the acceptance of cookies in general, and to activate the automatic deletion of cookies when the browser is closed. Disabling cookies may limit the functionality of this website.

Which cookies and services are used on this website is set out in this privacy policy.

Vercel Web Analytics

This website uses Vercel Web Analytics and Vercel Speed Insights, services of Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, USA. The services record page views, referrers, coarse location data (country) and technical performance metrics (Core Web Vitals). No cookies are set and no cross-device identifiers are stored; visitors are only distinguished by a daily rotating, non-reversible hash. Because no information is stored on or read from your device, no consent under Sec. 25 TTDSG is required; the services are therefore active regardless of your cookie decision. Processing is based on our legitimate interest in statistical evaluation and technical optimisation of our website (Art. 6 para. 1 lit. f GDPR). You may object to this processing at any time under Art. 21 GDPR. Further information: https://vercel.com/docs/analytics/privacy-policy.

Contact Form

If you send us inquiries via the contact form, the information provided in the inquiry form, including the contact details you provide, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not share this data without your consent.

The processing of this data is based on Art. 6 para. 1 lit. b GDPR, if your inquiry is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in effectively handling the inquiries addressed to us (Art. 6 para. 1 lit. f GDPR) or on your consent (Art. 6 para. 1 lit. a GDPR) if this has been requested; consent can be revoked at any time.

The data you enter in the contact form will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage ceases to apply (e.g., after your inquiry has been fully processed). Mandatory statutory provisions – especially retention periods – remain unaffected.

Data processing for form enquiries (Google Sheets, Resend)

The information submitted via our forms (contact and document requests, newsletter sign-up) is stored in a spreadsheet on Google Sheets. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Access to the spreadsheet is limited to a technical service account and the responsible members of staff.

In addition, we send an internal notification email for every enquiry via the service Resend. The provider is Resend, Inc., 2261 Market Street, San Francisco, CA 94114, USA. This email contains the contact details you provided and is sent exclusively to our own mailboxes.

The legal basis is Art. 6 para. 1 lit. b GDPR where the processing serves to answer your enquiry or to carry out pre-contractual measures, and otherwise your consent (Art. 6 para. 1 lit. a GDPR) or our legitimate interest in processing enquiries efficiently (Art. 6 para. 1 lit. f GDPR). We have concluded data processing agreements with both providers. Where data is transferred to the USA, the transfer is based on the European Commission's standard contractual clauses.

Further information: https://policies.google.com/privacy and https://resend.com/legal/privacy-policy.

Inquiry via email, phone, or fax

If you contact us via email, telephone, or fax, your inquiry, including all personal data resulting from it (name, inquiry), will be stored and processed by us for the purpose of handling your request. We will not share this data without your consent.

The processing of this data is based on Art. 6 Para. 1 lit. b GDPR if your inquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of inquiries addressed to us (Art. 6 Para. 1 lit. f GDPR) or on your consent (Art. 6 Para. 1 lit. a GDPR), provided this was requested; consent can be revoked at any time.

The data sent to us through contact inquiries will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions – in particular legal retention periods – remain unaffected.

5. Social Media

LinkedIn

We maintain a company profile on the LinkedIn network. The provider is LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland. On this website we merely link to that profile; no LinkedIn content or LinkedIn scripts are embedded. Data is only transferred to LinkedIn once you click the link.

When you visit our LinkedIn profile, LinkedIn is responsible for the data processing that takes place there. For the collection and transfer of data at the moment the profile is accessed, we are jointly responsible with LinkedIn (Art. 26 GDPR); the basis is our legitimate interest in an effective public presence (Art. 6 para. 1 lit. f GDPR). Details on data processing can be found in LinkedIn's privacy policy: https://www.linkedin.com/legal/privacy-policy.

6. Newsletter

Newsletter data

If you would like to receive the newsletter offered on the website, we require an email address from you as well as information that allows us to verify that you are the owner of the provided email address and agree to receive the newsletter. No further data is collected, or only on a voluntary basis. We use this data exclusively for sending the requested information and do not share it with third parties.

The processing of the data entered into the newsletter subscription form is based solely on your consent (Art. 6 para. 1 lit. a GDPR). You can revoke your consent to the storage of the data, the email address, and their use for sending the newsletter at any time, for example, via the “Unsubscribe” link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The data that you have provided to us for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter, and after unsubscribing or after the purpose has been fulfilled, will be deleted from the newsletter distribution list. We reserve the right to delete or block email addresses from our newsletter distribution list at our own discretion within the framework of our legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR.

Data stored with us for other purposes remains unaffected by this.

After you unsubscribe from the newsletter distribution list, your email address may be stored in a blacklist by us or the newsletter service provider if this is necessary to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be combined with other data. This serves both your interest and our interest in complying with the legal requirements in sending newsletters (legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR). The storage in the blacklist is not limited in time. You can object to the storage if your interests outweigh our legitimate interest.

7. Plugins and Tools

YouTube

On individual pages we embed videos from YouTube. The operator is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use a two-click solution in extended data protection mode (youtube-nocookie.com): no connection to YouTube is established when you open the page. Instead, you initially see only a placeholder with a corresponding notice. Only when you actively start the video is it loaded from YouTube and a connection to Google's servers established. The YouTube server is then informed about which of our pages you have visited.

After the video has been started, YouTube may also store various information on your device or use comparable recognition technologies (e.g. device fingerprinting). This allows YouTube to obtain information about visitors to this website. Among other things, this information is used to compile video statistics, improve usability and prevent fraud.

If you are logged into your YouTube account, you allow YouTube to assign your browsing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account.

The legal basis for loading the video is the consent you give by clicking (Art. 6 para. 1 lit. a GDPR and Sec. 25 para. 1 TTDSG). Consent applies to the individual playback; if you do not start a video, no data is transferred.

For more information on how user data is handled, please see YouTube's privacy policy: https://policies.google.com/privacy.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards for processing in the USA. Every company certified under the DPF undertakes to comply with these standards. Further information: https://www.dataprivacyframework.gov.

HubSpot

This website uses HubSpot, a service of HubSpot Ireland Limited, 1 Sir John Rogerson's Quay, Dublin 2, Ireland (parent company: HubSpot, Inc., 2 Canal Park, Cambridge, MA 02141, USA).

HubSpot is a marketing and customer relationship management platform. We use it server-side to manage enquiries and newsletter sign-ups (see the “Contact Form” and “Newsletter” sections). In addition, we embed the HubSpot tracking script in this website, which analyses your behaviour on our site (including pages visited, time spent, source of the visit) and recognises you via cookies and comparable recognition technologies. Your truncated IP address may be processed in this context.

The tracking script is loaded only if you have consented in the cookie notice. The legal basis is Art. 6 para. 1 lit. a GDPR and Sec. 25 para. 1 TTDSG. You can withdraw your consent at any time via the “Cookie settings” link in the footer of every page; the script will then no longer be loaded.

Where data is transferred to the USA, the transfer is based on the European Commission's standard contractual clauses. HubSpot, Inc. is also certified under the “EU-US Data Privacy Framework” (DPF). We have concluded a data processing agreement with HubSpot.

Details on data processing can be found in HubSpot's privacy policy: https://legal.hubspot.com/privacy-policy.

Fonts

This website uses the typefaces Inter and Prata as well as a proprietary display font. All font files are served locally from our own server and loaded into your browser cache when the page is opened. No connection to third-party servers, in particular to Google Fonts, is established. No cookies are set and no personal data is transmitted to third parties.
